188E Entrepreneur

Criteria

1)Business plan for entrepreneurial activity: You have a business plan for the complying entrepreneur activity** that demonstrates that the activity that you are undertaking or propose to undertake in NSW:

a) meets the Department of Home Affairs criteria

b) proves your commitment to maintain an ongoing relationship with NSW.

c) is proposed to lead to:

i. the development of an enterprise or business in NSW; or

ii. the commercialisation of a product or service in NSW

This activity must not relate to any of the following categories:

• residential real estate

• labour hire

• purchase of an existing enterprise or a franchise in Australia

2) Funds to settle in NSW: You can demonstrate that the net value of the business and personal assets is sufficient to support your settlement expenses in NSW.

You must have one or more legally enforceable agreements to receive funding with a total of at least AUD200,000. The funding must be from one of the following entities:

• Commonwealth Government agency

• State or Territory government agency

• Publicly funded research or innovation organisation

• Higher education provider specified as a Table A or Table B provider under Part 2-1 of the Higher Education Support Act 2003

• Investor registered as an Australian Venture Capital Limited Partnership or Early Stage Venture Capital Limited Partnership

At least 10% of the funding must be payable to the entrepreneurial entity within 12 months of the activity starting in Australia. This must be in the agreement.

The entity that will conduct the activity (the entrepreneurial entity) must be either an individual (yourself), a company or a partnership.

You must have held at least 30% interest in your entrepreneurial entity when you entered into the agreement.

 

作为188系列的新成员，188E（可理解为高新技术风险投资创业类商业移民签证）是一类综合商业投资和技术移民的新签证类型，是一个四年临时居住签证，创业四年后，如果创业成功，可以申请转永居签证。

适合人群：

雅思学霸、高学历、科研能力较强的企业家或者企业高管；

富有创新精神的高级管理人才、海外创业型人才、高科技创新型人才。
        审理周期： 不定

申请费用：3755澳币

申请条件：

1、 55周岁以下（或州/领地政府豁免年龄要求）；

2、 获得澳大利亚州/领地政府提名；

3、雅思成绩至少4个6分（或者托福、PTE、OET及CAE考试同等成绩）；

4. 关于将要从事的创业项目，申请人需要提供相关的、完整的商业计划书；

5. 根据已经获得的投资协议，将有资格至少获得20万澳元的资金，用于在澳洲创办/经营合规模的创业企业。且根据相应投资协议，至少10%的投资额将于经营活动开始后的12个月内注入此企业。

这20万澳元资金的来源，可以为下列一个、或多个投资方：

• 联邦政府机构；

• 州/领地政府；

• 政府资助的研究机构；

• 风险资本有限合伙公司、或早期风险资本有限合伙公司；以及

• 42所澳大利亚大学之一。

6. 申请人须持有该创业企业至少30%的股权；

满足条件的第三方在澳的资金机构，仅局限于以下：

• 州和地区政府State and Territory Governments；

• 联邦机构Commonwealth Agencies；

• 公开资助研究机构 Publicly Funded Research Organisations；

• 注册创业投资有限伙伴关系 （VCLP）、或早期阶段投资有限伙伴关系 （ESVCLP）的投资者Investors registered as a Venture Capital Limited Partnerships (VCLP), or Early Stage Venture Capital Limited Partnerships (ESVCLP)。

以下三条是明确指明在188E签证下不被接纳的生意行为：

-购买现成的生意或加盟店

-房地产相关的行为

-劳工雇佣
