188E Entrepreneur
Criteria:
Age
Applicants must be under 55 years of age.
Funding from a third party
The applicant must have a funding agreement in place with an authorised third party funding body for a total of at least A$200,000. You must have one or more legally enforceable agreements to receive funding with a total of at least AUD200,000. The funding must be from one of the following entities:
    •    Commonwealth Government agency
    •    State or Territory government agency
    •    Publicly funded research or innovation organisation
    •    Higher education provider specified as a Table A or Table B provider under Part 2-1 of the Higher Education Support Act 2003
    •    Investor registered as an Australian Venture Capital Limited Partnership or Early Stage Venture Capital Limited Partnership
At least 10% of the funding must be payable to the entrepreneurial entity within 12 months of the activity starting in Australia. This must be in the agreement.
The entity that will conduct the activity (the entrepreneurial entity) must be either an individual (yourself), a company or a partnership.
You must have held at least 30% interest in your entrepreneurial entity when you entered into the agreement.

Business plan
A detailed business plan or “pitch” document is required for the visa nomination application. Applicants should also provide information on the potential benefit to Victoria of the innovation in their business plan or as an attachment to the application.  
Applicants can re-use their business plan or “pitch” document that was submitted to obtain third party funding for the innovation idea.
Benefit to Victoria
Applicants must show how their proposed entrepreneurial activity will benefit Victoria. This is evaluated on a case by case basis. Factors taken into account include, but are not limited to:
    •    The nature of the innovation, whether it increases efficiencies, creates a dynamic product or improves existing services
    •    The potential economic contribution to be made to Victoria by the innovation, as well as any social or environmental benefits
    •    Whether the innovation addresses a significant need in an industry sector in Victoria
    •    Whether the innovation is likely to lead to employment opportunities for Victorians
    •    Whether a patent, design or trademark has been registered for the innovation.
Victoria encourages innovation and entrepreneurship. All factors particular to a case will be taken into consideration in our assessment.  Applicants must also demonstrate that either:
    •    the third party funding body has Victorian operations, or
    •    the entrepreneurial activity will be undertaken in Victoria.
Sufficient funds to settle in Victoria
The applicant and their dependents must have sufficient funds to settle in Victoria. Applicants are required to declare that they have sufficient funds for settlement in their Victorian visa nomination application. It is the responsibility of the applicant to research and determine the cost of living in Victoria to ensure their own financial resources are adequate for settlement. Living in Victoria
Applicants must have a genuine and realistic commitment to live in Victoria permanently and continue to contribute to Victoria through entrepreneurial activity. We will assess the applicant's settlement intentions as part of the nomination application.

州担保评估标准： 
1、满足DIBP对于188E创业者临时签证的要求。
2、年龄在55周岁以下。
3、创业活动必须涉及创新理念（创新可以是理念、产品或者过程，为企业、消费者、经济和社会创造更好的解决方案。创新创造就业、提高效率、打破成长的障碍。创新不一定是创造新产品，也可以是改进做事的方法。）。
4、提供商业计划，阐述创业活动对维州的潜在好处。
5、申请人和家人应有足够的定居资金。
6、创业活动期间申请人应该居住在维多利亚。 
7、证明创新活动有利于维多利亚州，包括但不限于：
 - 创新活动的本质是否提高效率、创造动态产品或者提高已有的服务.
 - 创新活动对维州的经济贡献、或者对社会和环境的好处。
 - 创新活动对于维州的产业是否特别需要。
 - 创新活动能否在维州创造就业岗位。
 - 创新活动是否注册了专利、设计或商标。
8. 根据已经获得的投资协议，将有资格至少获得20万澳元的资金，用于在澳洲创办/经营合规模的创业企业。且根据相应投资协议，至少10%的投资额将于经营活动开始后的12个月内注入此企业。
这20万澳元资金的来源，可以为下列一个、或多个投资方：
    •    联邦政府机构；
    •    州/领地政府；
    •    政府资助的研究机构；
    •    风险资本有限合伙公司、或早期风险资本有限合伙公司；以及
    •    42所澳大利亚大学之一。
9. 申请人须持有该创业企业至少30%的股权；
满足条件的第三方在澳的资金机构，仅局限于以下：
    •    州和地区政府State and Territory Governments；
    •    联邦机构Commonwealth Agencies；
    •    公开资助研究机构 Publicly Funded Research Organisations；
    •    注册创业投资有限伙伴关系 （VCLP）、或早期阶段投资有限伙伴关系 （ESVCLP）的投资者Investors registered as a Venture Capital Limited Partnerships (VCLP), or Early Stage Venture Capital Limited Partnerships (ESVCLP)。
以下三条是明确指明在188E签证下不被接纳的生意行为：
-购买现成的生意或加盟店
-房地产相关的行为
-劳工雇佣

188E签证VIC维多利亚州担保申请流程：
步骤1：通过SkillSelect提交EOI申请。
步骤2：准备申请材料（维州州担保条款、如果使用代理提供委托表、第三方机构的投资协议、以及商业计划书）。
步骤3：下载填写offline申请表，传到businessmigration@liveinvictoria.vic.gov.au（在线申请表正在开发，offline申请表是临时申请办法）。
步骤4：维州担保批准后，SkillSelect会自动发出EOI邀请.
步骤5：60天内向DIBP提交签证申请。
